General Terms and Conditions of Sale
These general terms and conditions of sale ("GTCS") apply, without restriction or reservation, to all sales of services ("Relaxation and cosmetic treatments") and cosmetic products ("Products") concluded by La Sultane de Saba with consumers and non-professional buyers ("Clients") on the website https://www.lasultanedesaba.com ("Site"), belonging to the company La Sultane de Saba.
La Sultane de Saba reserves the right to modify these general terms and conditions of sale at any time without notice. In such a case, the applicable general terms and conditions of sale are those in force at the time the order is placed on the Site. Placing an order on the Site implies the Client's full and unreserved acceptance of these general terms and conditions of sale, to the exclusion of any other document whatsoever.
Unless proven otherwise, the data recorded in the La Sultane de Saba computer system constitutes proof of all transactions concluded with the Client.
The Client declares that they have full legal capacity to commit to these general terms and conditions of sale.

ARTICLE 1: Relaxation and cosmetic treatments, and Products offered.
The website www.lasultanedesaba.com sells:
- Cosmetic products
- Relaxation and cosmetic treatments.
In accordance with Article L. 111-1 of the Consumer Code, the Client may, prior to any order, become aware of the essential characteristics of the Product(s) as well as the Treatments they wish to order on the Site by clicking on the link corresponding to the Product or Treatment.
The products offered on the Site are only valid while stocks last, as specified when placing the order. Our promotional offers are only valid for the indicated validity period and while stocks last.
ARTICLE 2: Prices
In accordance with Article L. 112-1 of the Consumer Code, the prices on this Site are indicated in Euros, including all taxes (TTC), excluding participation in shipping or provision costs.
The prices applicable on the Site are those in force on the day the Client places the order.
ARTICLE 3: Order
1) - Registration on the site
In order to place an order on the Site, the Client must create a user account by providing their surname, first name, email, and any information necessary for the delivery of their order.
Creating an account is necessary for placing orders.
The Client agrees to keep their username and password confidential. They take responsibility for all actions performed using their username and password. The Client guarantees to provide accurate, complete, and up-to-date information.
In the event that the information provided by the Client is false, incomplete, or obsolete, La Sultane de Saba reserves the right, without compensation and without notice, to suspend or terminate the Client's account, to delete all or part of the Client's data, without prejudice to any common law actions that may be available to it.
2) - Order.
The Client manages their basket: they add Products to their basket, modify quantities, and remove Products. To finalize their order, the Client must be logged into their account, and if they do not have an account, they must create one. The Client verifies their delivery and/or billing address. Payment is made exclusively by credit card. It is mandatory for the Client to accept the GTCS by checking the box "I accept the general terms and conditions of sale" to validate their order. Validation of the order by the Client implies their full and unreserved acceptance of these general terms and conditions of sale.
A confirmation email for the order is sent to the email address provided by the Client when creating their Client account. Transfer of ownership of the product will only take place upon full payment of your order. In case of a dispute regarding the payment of a previous order by the Client, we reserve the right to cancel the order.
ARTICLE 4: Payment terms
Payment is made only by online credit card at the time of order validation and in Euros. When paying online, indicate your credit card number, its expiration date, and the 3 digits on the back of the card. Online payment is secured by 3D Secure, authorizing Carte Bleue, Visa, Visa Electron, MasterCard, and Maestro cards.
ARTICLE 5: Delivery
Delivery
Delivery takes place at the address indicated by the Client. We decline all responsibility in the event of a delay or non-delivery originating from the transmission of erroneous or incomplete elements concerning the delivery address indicated by the Client. Upon delivery, the Client must verify the conformity of the received products before accepting the package and follow the instructions below in case of non-conformity. If the package is damaged, it must be refused on the grounds of "damaged package." No claim will be valid without compliance with this procedure.
Deadlines
La Sultane de Saba undertakes to deliver the order within a maximum period of 30 days from validation, except in case of product unavailability. Deliveries are free of charge and handled by La Poste services. The average delivery time for mainland France, Corsica, and Monaco is 7 days. Delivery times are provided as an indication. They may change due to various factors.
Product unavailability
In case of product unavailability noted after the order, La Sultane de Saba will immediately inform the Client and offer an extension of the initial delivery time or a product of equivalent quality and price. In case of refusal by the Client, La Sultane de Saba will immediately proceed to cancel the order and refund the sums paid by the Client.
Claims
Claims must be communicated to us within 48 hours from receipt of the order by electronic means at the following address: lasultanedesaba.siege@gmail.com, by phone: 01 48 59 03 29, or by mail to LA SULTANE DE SABA, 50 rue Racine, 93100 Montreuil. They must include: the Client's contact details, the order number, and the reasons for the claim. After this period, La Sultane de Saba is released from all liability.
Returns
No return will be accepted without our prior written agreement. Any risk linked to the return of products is borne by the Client. Return costs are borne by the Client.
ARTICLE 6: Right of withdrawal
"The consumer has a period of fourteen days to exercise their right of withdrawal from a contract concluded at a distance, following telephone solicitation or off-premises, without having to justify their decision or bear costs other than those provided for in Articles L. 221-23 to L. 221-25.
The period mentioned in the first paragraph runs from the day:
1° Of the conclusion of the contract, for service provision contracts and those mentioned in Article L. 221-4;
2° Of receipt of the goods by the consumer or a third party, other than the carrier, designated by them, for contracts for the sale of goods. For contracts concluded off-premises, the consumer may exercise their right of withdrawal from the conclusion of the contract." Furthermore, Article L. 221-24 of the Consumer Code specifies for refund deadlines following the exercise of the right of withdrawal:
"<< When the right of withdrawal is exercised, the professional shall reimburse the consumer for all sums paid, including delivery costs, without undue delay and at the latest within fourteen days from the date on which they are informed of the consumer's decision to withdraw. >>"
Finally, Article R.221-1 of the Consumer Code provides:
"The standard withdrawal form mentioned in 2° of Article L.221-5 appears in the appendix to this code."

.ARTICLE 7: Legal Warranties.
All Products provided by La Sultane de Saba are covered by the legal guarantees of conformity set forth in articles L. 217-4 to L. 217-14 of the Consumer Code and the guarantee against hidden defects set forth in articles 1641 to 1649 of the Civil Code, allowing the Customer to return delivered products that are non-conforming or defective.
- Consumer Code - Article L217-4: "The seller delivers goods that conform to the contract and is liable for any lack of conformity existing upon delivery. The seller is also liable for any lack of conformity resulting from the packaging, assembly instructions, or installation when the contract provides that it shall be performed by the seller or under its responsibility."
- Consumer Code - Article L217-5: "The goods are in conformity with the contract:
1° If they are fit for the purpose usually expected of similar goods and, where applicable:
- if they correspond to the description given by the seller and possess the qualities that the latter presented to the buyer in the form of a sample or model;
- if they possess the qualities that a buyer can legitimately expect given the public statements made by the seller, the producer, or their representative, particularly in advertising or labeling;
2° Or if they present the characteristics defined by common agreement between the parties or are suitable for any special use sought by the buyer, which has been brought to the attention of the seller and accepted by the latter."
- Consumer Code - Article L217-12: "The action resulting from a lack of conformity is barred after two years from the delivery of the goods."
- Civil Code - Article 1641: "The seller is bound by the warranty on account of hidden defects in the item sold which render it unfit for the use for which it was intended, or which so impair this use that the buyer would not have acquired it, or would only have paid a lower price for it, had he known of them."
- Civil Code - Article 1648, first paragraph: "The action resulting from redhibitory defects must be brought by the buyer within two years of the discovery of the defect."
ARTICLE 8: Return of Non-Conforming Products.
The consumer has a period of 6 months from the delivery of the goods to act under the legal guarantee of conformity, independently of any commercial guarantee that may be provided. In the event of a lack of conformity of the goods, the consumer may choose between their replacement or repair, unless the latter option proves manifestly excessive in cost. The consumer is exempt from having to prove the existence of the lack of conformity during the six months following the delivery of the goods. If the consumer invokes the warranty against hidden defects (Art. 1641 of the Civil Code), they may choose between the rescission of the sale or a reduction of the sale price (Art. 1644 of the Civil Code).
In the event of a failure to perform our obligation or in the case of a major defect, we commit to refunding you the full price paid or a portion of the price should you wish to keep the product.
Products must be returned to the following address: LA SULTANE DE SABA, 50 rue Racine 93100 Montreuil, France, in their original packaging, in the state they were in at the time of delivery of said Products, unused, and accompanied by all accessories (including gifts).
Refunds will be issued within 30 days following the compliant receipt of the product(s) by check.
Conditions and deadlines for reimbursement
Reimbursement is made by check within 30 days following the compliant receipt of the product(s).
ARTICLE 9: Intellectual Property
All comments, images, and illustrations on our site are exclusively reserved to us. Under intellectual property and copyright law, any use is prohibited except for private use.
ARTICLE 14: Liability
The photographs / illustrations / images on our site have no contractual value. Therefore, they cannot engage our liability.
The products offered comply with current French legislation.
La Sultane de Saba cannot be held responsible for the non-performance of the contract in the event of force majeure, or in the case of disruption or total or partial strike, notably of postal services and means of transport and/or communications.
La Sultane de Saba cannot be held responsible for any indirect damages that may occur due to the purchase of the products.
The site also contains information and links to other websites, and we cannot be held responsible under any circumstances for their content or any damages resulting from their use.
In the event of an order delivered to a country other than mainland France, the customer is the importer of the products purchased. The customer is solely responsible for declaring and paying any customs duties or other taxes that may be required in their country. La Sultane de Saba cannot be held responsible if customs fees are applied in your country of delivery.
ARTICLE 15: Personal Data
CNIL declaration number: 1807634.
The site ensures the collection and processing of personal information for the Customer, respecting privacy in accordance with Law No. 78-17 of January 6, 1978, relating to data processing, files, and individual liberties.
The information collected consists of: email address, surname, first name, address, postal code, and phone number, in order to enable the processing and delivery of ordered products.
Commercial offers from the Site will be sent to the Customer electronically unless the Customer has opted out. The Customer may at any time object to commercial offers free of charge by logging into their personal space or by writing to the following address: LA SULTANE DE SABA, 50 rue Racine, 93100 Montreuil.
Information regarding the Customer may be transmitted to commercial partners of the Site, unless the Customer objects.
By virtue of articles 39 and 40 of the French law dated January 6, 1978, the Customer has the right to access, rectify, delete, and object to their personal data. ARTICLE 16: Competent Jurisdiction and Applicable Law
These general terms and conditions of sale are subject to the application of French law. The district court (tribunal d'instance) shall have jurisdiction for disputes with an amount less than or equal to €10,000, and the high court (tribunal de grande instance) for disputes with an amount greater than €10,000. This applies to both substantive and procedural rules. MEDIATION
"In accordance with the provisions of the Consumer Code regarding the amicable settlement of disputes, La Sultane de Saba adheres to the e-commerce Mediation Service of the FEVAD (Federation of E-commerce and Distance Selling), whose contact details are as follows: 60 Rue La Boétie – 75008 Paris – http://www.mediateurfevad.fr. Following a prior written approach by the consumer to La Sultane de Saba, the Mediation Service may be referred to for any consumer dispute that has not been resolved.
